1. Acceptance of terms
By registering a business, making a booking, or using any part of the Zotheka Network MW platform (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated terms.
2. What Zotheka Network MW provides
Zotheka Network MW is an online booking and discovery platform that connects local businesses in Malawi with customers. We provide:
- A public directory where customers can discover, review, and book local businesses
- A business dashboard for managing listings, services, bookings, and customer communications
- A booking system allowing customers to reserve services without requiring an account
- Communication tools including in-platform chat and WhatsApp integration
Zotheka Network MW is a marketplace platform. We are not a party to any transaction between a customer and a business. All service delivery is solely the responsibility of the business.
3. Business accounts
Registration: Businesses must register with accurate information. You are responsible for maintaining the security of your account credentials.
Free trial: Every new business receives a 7-day free trial with no payment required. At the end of the trial, the business must subscribe to a paid plan or their listing will be hidden from the public directory.
Listing accuracy: Businesses are responsible for ensuring their listing — including services, prices, hours, and location — is accurate and up to date. Misleading listings may be removed.
Conduct: Businesses must honour bookings made through the Platform, respond to customer enquiries in a timely manner, and conduct themselves professionally. Repeated cancellations or customer complaints may result in account suspension.
4. Customer bookings
Customers can make bookings without creating an account. By making a booking, you:
- Agree to provide accurate contact information
- Understand that the booking is a reservation request, not a guaranteed service until confirmed by the business
- Accept that cancellation policies are set by the individual business
- Agree not to leave false or malicious reviews
Keep your booking reference number (e.g. ZNM-XXXXXX). You will need it to track, manage, or cancel your booking.
5. Payments and subscriptions
Business subscriptions: Paid plans are billed monthly (30-day cycles) from the date of activation. Prices are in Malawian Kwacha (MWK).
Payment methods: Payments are currently accepted via mobile money or bank transfer confirmed through WhatsApp. Automatic card payments via Paychangu are available where enabled.
Renewal: Subscriptions do not auto-renew automatically. Businesses will be notified 3 days before renewal is due and must confirm payment to continue.
Refunds: Subscription fees are non-refundable once a billing cycle has begun. If you believe there has been an error, contact us immediately.
Customer payments: Payments for services are made directly between customers and businesses. Zotheka Network MW does not process or hold customer payments on behalf of businesses.
6. Content and conduct
Users must not post content that is:
- False, misleading, or fraudulent
- Defamatory, abusive, or harassing
- In violation of any applicable Malawian law
- Spam, unsolicited advertisements, or irrelevant content
- Content to which you do not hold the rights
We reserve the right to remove any content that violates these guidelines without notice.
7. Privacy
Your privacy matters to us. Please read our Privacy Policy to understand how we collect, use, and protect your information.
By using the Platform, you consent to the data practices described in our Privacy Policy.
8. Limitation of liability
Zotheka Network MW is a marketplace that connects businesses and customers. To the fullest extent permitted by law:
- We are not liable for the quality, safety, or delivery of any service provided by a business on the Platform
- We are not liable for any disputes between customers and businesses
- We do not guarantee that the Platform will be available at all times without interruption
- Our total liability to any user shall not exceed the subscription fees paid in the 30 days prior to the claim
9. Termination
We reserve the right to suspend or terminate any account that violates these Terms, engages in fraud, or causes harm to other users or the Platform. Businesses may close their account at any time by contacting us.
On termination, your public listing will be removed, but booking records and transaction history will be retained for the legally required period.
